Part I

Sales channels on the E.LECLERC.fr website

Article 1 Definitions

For the purposes of these General Terms and Conditions of Sale, the following capitalized terms shall have the following meanings:

E.Leclerc Center: any hypermarket, supermarket and/or specialized physical store operating under the E.Leclerc brand and offering Products through the "Click and Collect" service on the Website.

Customer: any natural or legal person who wishes to purchase and use Products on the Website.

Seller-specific terms: specific terms of sale for third-party sellers.

General Terms and Conditions of Sale: these General Terms and Conditions of Sale.

LCOMMERCE: any company offering Products on a website operated by it, as indicated below.

Marketplace: the area on the Website reserved for third-party sellers to post offers.

Offer: a set of pre-contractual information relating to the Products sold on the Website, including information such as price, availability, product type and delivery times.

Website: Global e-commerce website https://eleclercen.com

Third-party sellers: professional sellers who sell products on the Website platform.

Article II: Three types of offers available on the Website and their publishers

LCOMMERCE has developed three different sales channels for its customers on the Website, namely:

- Offers of LCOMMERCE products labeled "Sold by E.Leclerc" (hereinafter referred to as "LCOMMERCE Offers"); LCOMMERCE is the publisher of the Offers;

Items marked "Sold by E.Leclerc.fr" (hereinafter referred to as "E.Leclerc.fr Global")

- Items sold by E.Leclerc Center through the "Click and Collect" service, marked "Sold by E.Leclerc [+ logo of the corresponding E.Leclerc Center]" (hereinafter referred to as "Click and Collect"); LCOMMERCE is the supplier of these items;

- All Marketplace items offered by professional third-party sellers, marked "Sold by [name of the seller]" (hereinafter referred to as "Marketplace Products"); LCOMMERCE is the supplier of these items.

The supplier of the goods will be indicated in the goods description and may be LCOMMERCE, the E.Leclerc Center or a third party seller.

2.1 LCOMMERCE Offers

For products marked "Sold by E.Leclerc", the offeror is LCOMMERCE, whose contact details are as follows:

LCOMMERCE is a general partnership with registered office in Ivry-sur-Seine, 94200, France, registered under number 882 736 077 and NAF code 4791B.

For online sales, LCOMMERCE (the subsidiary of Galec responsible for this website) sells on behalf of E.Leclerc physical stores and its related concepts (such as E.Leclerc pharmacies).

2.2 Click & Collect Offers

The "Click & Collect" service connects the Customer to the E.Leclerc Center on the Website. The E.Leclerc Center offers the Products for sale and the Customer can purchase them through the E.Leclerc.fr network within two hours of placing the order. Click and Collect.

The Customer can access the Click and Collect offers on the Website by selecting the E.Leclerc Centre of their choice and viewing the products available through its Click and Collect service.

The Customer can view the identity of the E.Leclerc Centre and its Click and Collect terms and conditions by clicking on the name of the E.Leclerc Centre seller on the product page.

These Click and Collect terms and conditions apply only to each E.Leclerc Centre and are separate from the general terms and conditions of sale of LCOMMERCE and third-party sellers.

Products sold by E.Leclerc Centres are their own responsibility and LCOMMERCE does not provide returns or exchanges.

Transactions related to Click and Collect offers are always concluded directly between the E.Leclerc Centre specified in the offer and the Customer.

2.3 Marketplace Offers

The Marketplace is a service that connects Customers with third-party sellers on the Website. Any seller who joins the E.Leclerc Marketplace is a professional activity, both for individuals and legal entities.

In this context, third-party sellers offer new or second-hand products for sale to customers.

By clicking on the name of the third-party seller on the product page, the customer can access the identifying information of the offer and the terms and conditions of any specific seller.

These specific seller conditions vary for each third-party seller and may differ from the General Terms and Conditions of Sale of LCOMMERCE and the General Terms and Conditions of Sale of E.Leclerc Center Click & Collect.

Products sold by third-party sellers are subject to the following conditions:
